I Scream, You Scream...

Some guy on NW 10th Street is screaming the loudest.

According to the Crime Watch section of the paper today, he has called police repeatedly to complain that the ice cream man makes too much noise driving by his house. I live in the general vicinity and the ice cream guy in our neighborhood is a 20-year-old kid who rides an ice cream bike. It's not even a van. The music isn't particularly loud, although he does circle through the neighborhood a couple times a day. Why not? It's a neighborhood with lots of eager kids.

As someone who works odd hours and often has to sleep during daylight hours, I know that noise sensitivity can be an issue. But this gentleman called the police three times and actually managed to get the police to write up a noise citation and probably scare this bloke away from his block for good. What a grump.

  • Do you know who he is? Is he known as a grumpy guy?
Maybe all the neighborhood kids should get together and whine (rather loudly)that "it's toooo hot. Why won't the ice-cream man visit anymore?" for hours on end...
    in front of his house.
Or they could set up their own popsicle cooler and yell at the top of their little lungs... "Popsicles!! Get your Popsicles HERE!!!
What will the police do then, ticket the kids for being young entrepreneurs? Making kid noise in the day? Geez.
    I know... a childish reaction...oh well!
Maybe he was traumatized by the Good-Humor man as a child.

    Sorry Corvallist, that stinks.

  • Hi Corvallist,

I'm the owner of the ice cream bike and will be accompanying this young OSU student to the Corvallis Municipal Court tomorrow morning.

I'm going to ask the judge to assign the citation (which BTW is $350 and considered a criminal charge) to me since I am the person responsible for the bikes (well my two) and the drivers that operate them. Regardless of what the judge decides I (we) will be pleading not guilty and requesting a trial.

I've run my two IC bikes in Corvallis since 1992 and have run summer IC for 26+ years. NEVER have I ever run into the likes of this!

The day of the citaion a Corvallis Police officer (knowing I was the owner) arrived at my door and advised me of the complaint. The CPD officer and I discussed the situation at length and I made it clear that any citation should be issued to me being the responsible party and all seemed okay. The officer asked for a contact number so he could touch base with the driver and believing we had resolved the situation I gave him the number. While looking it up on my cell I asked him to PLEASE not use the scare tactics of threatening the driver with a $350 fine and a civil suit by the City of Corvallis which another CPD officer used on this poor guy back on the 4th of July.

The officer assured me no citation would be issued and that he simply needed to "make contact" with this young man. What an idiot I was!

I won't take up anymore of your time but there is very much more to this story than meets the eye.

I'm VERY disappointed with CPD and how this all came about. For the last 14 years my summer IC bikes have provided both OSU and Corvallis high students an opportunity to make some money, actively interact with the Corvallis community and gain some basic business and customer service skills.

For this season, I've parked the second bike and will take the off season to decide whether I will continue providing this service again or not.

If all it takes is ONE person to decide he doesn't like a particular driver then enlist the backing of CPD to execute his wishes, then I won't be running the ol Orange and Black IC bikes anymore..

Thanks for allowing me to vent and to all those who have spoken out on this issue. Perhaps I'll see you in court! LOL!

  • Just an update from this mornings court appearnce;

Judge would not reassign citation from drive to me, not guilty plea was entered and trial hearing schedule for 9/21/2006 @ 1:30pm Corvallis Municipal Court.

I had a chance to review the report submitted by the officer who issued the citation and found that I was in error regarding this officer's intentions. I apologize for infering that his intentions were anything but honorable. The officer involved submitted a well balanced report of the incident and handled this "unusual" situation to the best of his ability.

My thanks go to this officer for submitting an objectively complete report and for restoring my faith (at least partially)in what was once one of the most highly regarded police departments in the nation!

    Beau
